Colombian Appeals Court Protects Joseph Anthony Camp’s Rights to Honor, Good Name, and Human Dignity

In its decision dated July 2, 2026 (Radicación No. 11001310300320260029301), the Tribunal revoked the June 11, 2026 first-instance judgment of the Juzgado Tercero Civil del Circuito de Bogotá and granted Camp’s tutela action against content published by Danesh Noshirvan on Instagram (@thatdaneshguy) and Substack (ThatDanesh).

The Court found that specific statements labeling Camp a “Child Stalker,” “registered sex offender” “white supremacist who targets women and children with sexual assault for a fee,” and “Real Rapist,” along with any other content imputing criminal conduct without support in a judicial decision, exceeded the constitutional limits of freedom of expression. These were determined to be factual criminal accusations presented to a large audience without judicial backing, rather than protected opinions or criticism.

The Tribunal ordered Meta Platforms Inc., as administrator of Instagram, and Substack Inc. to remove the identified publications from the accounts @thatdaneshguy and ThatDanesh within 48 hours of notification of the ruling. It further ordered Danesh Noshirvan to refrain from publishing on digital platforms any content that imputes to Camp the commission of criminal acts without support in a judicial decision.

The Court confirmed that Camp had satisfied the procedural requirements for the tutela, including prior formal requests for retraction and removal directed to Noshirvan and reports submitted to the platforms. It also affirmed its jurisdiction based on the effects produced in Colombia.
